Decision & Inquiry Report on Potential Declaration of Certain Mobile Wholesale Services

NICTA has now concluded a Public Inquiry (Inquiry) that was commenced in June 2013 on whether certain wholesale mobile telecommunications services should be recommended to the Communications and Information Minister, for declaration under Part VI of the National Information and Communications Technology Act 2009. The wholesale services that were subject of the Inquiry were;

  1. domestic inter-network mobile roaming services; and
  2. facilities access services associated with mobile network facilities (including access to telecommunications transmission towers).

Based on the findings of this Inquiry, NICTA concluded that the declaration of these wholesale mobile services would NOT satisfy the declaration criteria specified under section 128 of the Act. The findings of the inquiry are now before the Minister to make a decision on whether or not to accept NICTA’s recommendation.
